MUSICAL ENGLISH REFUND POLICY

Effective Date: September 29, 2015

Musical English wants customers to understand the return and refund terms that apply before making a purchase. Because Musical English offers different types of products and services—including physical books, teacher training, early-launch programs, online courses, and future parent and homeschooling programs—different refund rules apply to different purchases.

This Return & Refund Policy applies to qualifying purchases made directly from Musical English or www.MyMusicalEnglish.com, unless a particular offer, sales page, checkout page, or written agreement expressly provides different terms.

By completing a purchase, you acknowledge and agree to the refund terms applicable to that product or program.

1. Founding Teacher Program — All Sales Final

The Musical English Founding Teacher Program is an early-stage business-launch opportunity intended for individuals who choose to participate at the foundational stage of the expanded Musical English teacher-training launch.

The currently planned Founding Teacher enrollment price is approximately $997, although the price displayed at checkout at the time of purchase will control.

Because Founding Teachers are receiving early-entry pricing and access during the initial development and rollout of the expanded Musical English teacher program:

ALL FOUNDING TEACHER PROGRAM SALES ARE FINAL AND NON-REFUNDABLE.

No refund, cancellation, credit, or charge reversal will be provided merely because a Founding Teacher changes their mind, decides not to complete the training, does not use the training, determines that the program is not a fit for their plans, or is unable to devote the anticipated time to the program.

Founding Teacher participants should review the offer carefully before purchasing and should enroll only if they understand and accept the early-stage nature of the program.

The Founding Teacher Program may continue to develop, expand, reorganize, or improve as Musical English builds its teacher-training system. The fact that portions of the program may be released, updated, expanded, or modified during the launch period does not create a right to a refund, provided Musical English continues to deliver the material substance of the purchased program.

The no-refund requirement should also be clearly displayed on the Founding Teacher sales page and at checkout before payment is submitted.

2. Founding Teacher Payment Plans

If Musical English offers the Founding Teacher Program through an installment or payment plan, the payment plan is a method of paying the total purchase price and is not a month-to-month subscription unless Musical English expressly states otherwise.

Because the Founding Teacher Program is non-refundable, discontinuing participation does not automatically cancel remaining scheduled installment obligations.

Any different payment-plan cancellation terms must be expressly stated in writing on the applicable offer or checkout page.

3. Regular Musical English Teacher Training — 90-Day Money-Back Guarantee

After the Founding Teacher launch period, certain regular Musical English Teacher Training programs may be sold with a 90-day money-back guarantee.

Where a sales page or checkout page expressly states that the 90-day guarantee applies, a purchaser may request a refund within 90 calendar days from the original date of purchase, subject to this Policy.

The purpose of the guarantee is to give a participant a reasonable opportunity to begin the Musical English training and determine whether the program is appropriate for them.

To qualify for a refund:

The refund request must be submitted within the applicable 90-day period; the purchaser must provide enough identifying information for Musical English to locate the transaction; the request must relate to a program that expressly includes the 90-day guarantee; and the purchaser must discontinue use of the refunded Musical English training, course materials, downloads, LMS access, and other proprietary resources following approval of the refund.

Once a qualifying refund is approved, Musical English may terminate or disable access to the applicable course, LMS, membership, teacher resources, downloads, community, or other services associated with the refunded purchase.

Any teaching, commercial-use, curriculum-use, trademark-use, or other rights that arose solely from the refunded purchase will also terminate unless a separate written agreement expressly provides otherwise.

4. Reasonable Use of the Teacher-Training Guarantee

The 90-day guarantee is intended to allow customers to evaluate the Musical English training in good faith. It is not intended to provide temporary free access to proprietary training or copyrighted resources.

Musical English reserves the right to review refund requests involving apparent fraud, repeated purchases and refunds, unauthorized copying or distribution of materials, account sharing, intellectual-property misuse, or other conduct reasonably indicating abuse of the guarantee.

Nothing in this section is intended to restrict refund rights that cannot legally be restricted.

5. Teacher Training Purchased Through a Payment Plan

If a qualifying regular Teacher Training Program is purchased through an installment plan and a refund request is approved within the applicable guarantee period, Musical English may cancel remaining scheduled installments and refund eligible payments already received for the refundable training purchase, subject to the terms of the applicable offer.

If a specific checkout page or written agreement states different installment-refund terms, those terms will control.

This section does not apply to the Founding Teacher Program, which is non-refundable unless Musical English expressly states otherwise in writing.

6. Parent, ESL, Homeschooling, and Home-Learning Programs

Musical English plans to offer parent-facing digital programs that may include ESL learning, homeschooling resources, parent-guided learning, Musical English video lessons, and other home-learning programs delivered through an LMS or similar online platform.

Qualifying programs may include a:

90-Day Money-Back Guarantee

Where the guarantee is expressly offered, a purchaser may request a refund within 90 calendar days from the original purchase date.

The guarantee provides families with an opportunity to evaluate the program and determine whether the learning format is appropriate for their household.

To qualify, the request must be received within the applicable 90-day period and must relate to a product that expressly includes the guarantee.

Once a refund is approved, access to the applicable LMS, video lessons, downloads, memberships, digital resources, or other program content may be terminated.

7. Abuse of Digital Program Guarantees

The parent, ESL, and homeschooling guarantee is intended for customers evaluating the program in good faith.

Musical English may review refund requests where there is evidence of fraud, unauthorized copying, redistribution, account sharing, repeated purchase-and-refund activity, commercial misuse of the materials, or another apparent attempt to obtain substantial proprietary content without paying for it.

A legitimate customer does not need to prove that the program “failed” or guarantee a particular outcome in order to submit an otherwise qualifying refund request.

8. Educational Results Are Not Guaranteed

A refund guarantee does not mean Musical English guarantees a particular educational outcome.

Children differ in age, language experience, participation, learning environment, frequency of practice, interests, and other factors.

Musical English does not guarantee that a child will achieve a particular vocabulary level, pronunciation level, academic result, communication ability, developmental result, or other specific educational outcome.

Similarly, Musical English Teacher Training does not guarantee employment, student enrollment, business revenue, profitability, or other financial results.

9. Books and Physical Educational Materials

Musical English may sell physical books, printed curriculum resources, and other tangible educational materials.

A physical book or other returnable physical item may qualify for a refund if and only if the item has not been used and otherwise satisfies the requirements of this Policy.

Used products are not refundable.

Examples of circumstances that may cause an item to be treated as used include writing in the book, marking pages, completing activities in the book, materially damaging the book through use, removing or using consumable components, or otherwise using the product in a manner inconsistent with its being returned as an unused item.

Reasonable handling solely to inspect the product does not necessarily constitute use.

10. Physical Products Must Be Returned Before Refund

Musical English must receive the qualifying physical product before issuing the applicable product refund.

Customers should not send merchandise to an unrelated address or to a third-party vendor unless instructed to do so by Musical English.

Before returning an item, contact:

[INSERT RETURNS EMAIL]

to obtain the correct return instructions and current return address.

Returns sent to an incorrect location may delay or prevent processing of the refund.

11. Customer Is Responsible for Return Shipping

The customer is responsible for all costs associated with returning a physical product to Musical English unless Musical English expressly agrees otherwise or applicable law requires otherwise.

Musical English does not pay or reimburse return shipping costs for ordinary returns.

Customers are encouraged to use a traceable shipping method because the customer remains responsible for the return until it is received at the designated return location.

12. Original Shipping Charges

Unless Musical English shipped the wrong product, the product arrived materially defective, applicable law requires otherwise, or Musical English expressly agrees otherwise, original shipping and handling charges are not refundable.

[This is a recommended provision. Musical English should confirm this business decision before publication.]

13. Damaged, Defective, or Incorrect Products

If you receive a physical product that is materially damaged in transit, defective, or different from the product ordered, contact Musical English promptly after delivery.

Musical English may request reasonable information such as the order number, description of the issue, and photographs showing the condition of the product or packaging.

After reviewing the issue, Musical English may provide an appropriate remedy, which may include replacement, correction of the order, or refund where appropriate.

This section is separate from an ordinary change-of-mind return.

14. Third-Party Book or Product Purchases

Some Musical English books or other products may eventually be printed, sold, shipped, or fulfilled through third-party printers, retailers, distributors, marketplaces, or fulfillment providers.

If a purchase is completed directly through a third-party seller rather than Musical English, that third party's return and refund policy may govern the transaction.

Musical English cannot necessarily issue a refund for money paid directly to an independent retailer or marketplace.

Customers should review the applicable seller's policies before purchasing through a third-party platform.

15. Digital Downloads

Except where included within an expressly stated money-back guarantee, standalone downloadable materials may be non-refundable after access or delivery because digital content cannot practically be returned.

If Musical English sells standalone digital downloads in the future, the applicable checkout page will identify whether the product is refundable and any conditions that apply.

16. Seminars, Webinars, and Live Events

Refund or cancellation terms for paid seminars, webinars, workshops, live training events, or similar programs may vary according to the event.

The applicable registration or checkout page will state the cancellation and refund terms for the event.

Free events do not create a monetary refund right.

17. Subscriptions and Recurring Services

Musical English may later offer recurring services such as LMS memberships, parent memberships, business technology, websites, automation services, support programs, or other subscription-based services.

Subscription cancellation and refund terms will be disclosed before purchase.

Canceling a subscription generally stops future renewal charges but does not automatically create a refund for previous billing periods unless the applicable offer or law provides otherwise.

18. Promotional and Discounted Purchases

A promotional or discounted purchase remains subject to the refund policy applicable to that product unless the promotion clearly states different terms.

A discount by itself does not eliminate an otherwise expressly offered guarantee.

The Founding Teacher Program is different because its no-refund condition is a specific term of the Founding Teacher offer, not simply a consequence of receiving a discount.

19. Refund Request Procedure

To request a refund for a qualifying purchase, contact Musical English at:

Email: [INSERT REFUND/SUPPORT EMAIL]

Subject: Refund Request — Musical English

Please provide your name, email address used for the purchase, order or transaction information if available, the product or program purchased, purchase date, and a brief statement identifying the refund being requested.

Musical English may request additional information reasonably necessary to verify the purchase and determine whether the request falls within the applicable policy.

20. Refund Method

Approved refunds will generally be returned through the original payment method where reasonably possible.

The timing of a refund appearing in a customer's account may depend on the payment processor, card issuer, bank, or other financial institution.

Musical English cannot control processing delays caused by a customer's financial institution or third-party payment provider.

21. Chargebacks and Payment Disputes

Customers are encouraged to contact Musical English before initiating a payment dispute or chargeback so that we have an opportunity to review and resolve legitimate concerns.

Initiating a chargeback does not change the terms of this Return & Refund Policy.

Musical English may provide applicable purchase records, checkout disclosures, refund terms, account-access records, communications, or other relevant information to a payment processor or financial institution when responding to a payment dispute.

Nothing in this section limits a customer's lawful rights.

22. Fraud and Misrepresentation

Musical English reserves the right to deny or investigate a refund request reasonably believed to involve fraud, material misrepresentation, unauthorized payment activity, misuse of a refund guarantee, unauthorized copying or redistribution of copyrighted materials, or other unlawful conduct.

This does not affect consumer rights that cannot legally be waived.

23. Termination of Access Following a Refund

When a digital-program or teacher-training refund is approved, Musical English may immediately or promptly terminate the purchaser's access to the refunded program and related LMS areas, videos, digital downloads, teacher communities, training resources, proprietary materials, and other benefits associated solely with that purchase.

The purchaser must discontinue use of Musical English proprietary materials and any rights that were conditioned upon maintaining the applicable purchase or enrollment.

24. Physical Materials Included With Digital Programs

Where books or other physical products are purchased separately from a digital course, the physical products are governed by the physical-product return provisions of this Policy.

If Musical English later bundles physical products into a course price, the applicable sales page may establish additional rules concerning whether those materials must be returned as part of a course refund.

Musical English should define those bundle-specific terms before selling such packages.

25. Refunds Required by Law

Nothing in this Policy is intended to eliminate or restrict refund, cancellation, cooling-off, or other consumer rights that cannot lawfully be waived.

Where applicable law provides rights that are more favorable to a customer than this Policy, applicable law will control.

26. Changes to This Policy

Musical English may revise this Return & Refund Policy as products, programs, technology, and business operations evolve.

Changes will generally apply to purchases made after the revised Policy becomes effective unless applicable law permits or requires otherwise.

The terms in effect at the time of purchase will generally govern that purchase.

27. Relationship to Other Musical English Agreements

This Return & Refund Policy is incorporated into the Musical English Terms of Use.

Certain purchases may also be subject to teacher agreements, license agreements, enrollment agreements, subscription terms, or product-specific terms.

If a separately executed written agreement or clearly disclosed product-specific refund term conflicts with this general Policy, that specific agreement or disclosure will control with respect to the subject matter it expressly addresses.
