These Terms of Use and Terms of Service (“Terms”) govern your access to and use of MyMusicalEnglish.com and any related Musical English websites, forms, surveys, courses, learning-management systems, teacher-training programs, educational materials, books, videos, music, communications, communities, products, services, and other online or offline offerings that reference or incorporate these Terms.

For purposes of these Terms, “Musical English,” “we,” “us,” and “our” refer to Musical English and the legal business entity or entities operating MyMusicalEnglish.com and the applicable Musical English services.

By accessing our website, creating an account, purchasing a product or service, enrolling in a course, participating in teacher training, or otherwise using Musical English services, you acknowledge that you have read and agree to these Terms and our Privacy Policy.

If you do not agree with these Terms, do not use the applicable Musical English website, product, course, or service.

1. About Musical English

Musical English provides educational programs and resources designed to help young children practice English and communication through activities that may include songs, rhythm, music, movement, dance, acting, role-play, storytelling, classroom activities, and performance.

Musical English may also provide teacher education, teacher-training programs, educational resources, books, curriculum materials, online courses, video lessons, parent-guided learning programs, homeschooling resources, ESL learning resources, business-education materials, seminars, communities, and related services.

The specific products, programs, features, materials, rights, support, and services available may change over time.

2. Initial Teacher-Training Launch

The initial Musical English business launch is focused primarily on providing training and resources to individuals interested in learning how to teach Musical English.

Participants may be interested in using Musical English with their own children, private students, preschools, Montessori schools, after-school programs, learning centers, schools, homeschool groups, community programs, or other appropriate educational settings.

Participation in teacher training does not by itself create employment with Musical English.

Unless expressly stated in a separately executed written agreement, participation also does not create a partnership, joint venture, agency relationship, franchise, dealership, exclusive territory, employment relationship, or other business relationship with Musical English.

Any authorization to use Musical English intellectual property, curriculum, books, music, trademarks, teaching materials, or other proprietary resources is governed by the applicable written agreement, license, enrollment terms, or program terms.

3. Future Parent, ESL, and Homeschooling Programs

Musical English may later offer online programs directly to parents and families, including ESL learning programs, homeschooling resources, parent-guided instruction, video lessons, children's educational activities, and related learning services.

These services may be provided through a learning-management system (“LMS”) or other online platform.

Additional terms may apply to a particular course, membership, subscription, parent program, or LMS service. Where additional program-specific terms conflict with these general Terms, the program-specific terms will control with respect to that program.

4. Eligibility and Adult Users

Website purchases, teacher-training enrollments, contracts, business inquiries, parent registrations, and account creation are intended for adults who are legally capable of entering into agreements.

By making a purchase or entering into an agreement with Musical English, you represent that you are legally capable of doing so in your jurisdiction.

Parents and legal guardians are responsible for supervising children's use of Musical English materials and online services.

Children should not independently create accounts, make purchases, enter contracts, or submit personal information unless a Musical English service specifically allows such participation and appropriate parental authorization has been obtained.

5. Accounts and LMS Access

Certain Musical English services may require an account or LMS login.

You agree to provide accurate information and to maintain the confidentiality of your login credentials. You are responsible for activity occurring through your account unless the activity results from circumstances for which Musical English is legally responsible.

Unless Musical English expressly provides otherwise, an account is intended for the registered purchaser or authorized user and may not be sold, transferred, shared, sublicensed, publicly distributed, or made available to unauthorized users.

You agree to notify Musical English promptly if you believe your account or credentials have been compromised.

6. Course and Training Access

Purchasing or enrolling in a Musical English course provides access only to the course, materials, rights, and services expressly included in the applicable offer at the time of purchase.

Course access may include video lessons, written lessons, downloads, demonstrations, training materials, instructional resources, webinars, seminars, communities, or other resources depending on the particular program.

Musical English may update, reorganize, improve, replace, or modify course content as the program develops, provided that such modifications are consistent with the material nature of the purchased program and applicable law.

Unless expressly promised in writing as part of a purchase, enrollment does not guarantee access to every future Musical English program, product, feature, technology, curriculum addition, update, service, seminar, or resource.

7. Founding Teacher Program

From time to time, Musical English may offer participation in a Founding Teacher Program or similar early-launch opportunity.

The Founding Teacher Program is an early-stage launch offering intended for individuals who choose to participate while Musical English is building and implementing its expanded teacher-training system.

Participants acknowledge that an early-stage or founding program may continue to evolve and that elements of the training, technology, presentation, support systems, resources, and implementation process may be developed, updated, reorganized, or released progressively.

The exact benefits, access rights, teaching rights, curriculum rights, support, materials, and other components of a Founding Teacher purchase will be determined by the applicable offer and written agreement.

Founding Teacher Refund Policy

Unless Musical English expressly states otherwise in writing before purchase, Founding Teacher Program purchases are final and non-refundable.

The currently planned Founding Teacher enrollment price is approximately $997, but the price in effect on the actual checkout or offer page will control.

The Founding Teacher price reflects participation at an early stage in the Musical English teacher-training launch. A participant should purchase only after reviewing the applicable offer and determining that participation is appropriate for them.

The no-refund condition should also be displayed prominently during the purchase process and will be incorporated into the Musical English Return & Refund Policy.

8. Regular Teacher-Training Refund Guarantee

Musical English may offer a 90-day money-back guarantee for certain regular teacher-training programs sold after the Founding Teacher launch.

The existence and terms of a guarantee will be stated on the applicable offer or checkout page.

Unless a particular offer states otherwise, the guarantee period begins on the date of purchase.

Additional reasonable conditions may be described in the Return & Refund Policy, including procedures for requesting a refund, termination of course access following a refund, discontinuation of rights to use Musical English proprietary materials, and treatment of physical products or downloadable resources.

A guarantee applies only where expressly offered. The Founding Teacher Program is excluded from the regular 90-day guarantee unless Musical English expressly states otherwise in writing.

9. Parent, ESL, and Homeschooling Program Guarantee

Musical English intends to offer a 90-day money-back guarantee on qualifying parent, homeschooling, ESL, or home-learning digital programs.

The applicable sales page and Return & Refund Policy will identify which products qualify.

Unless a particular offer states otherwise, the guarantee period begins on the date of purchase.

If a qualifying refund is issued, Musical English may terminate LMS, course, membership, download, or other program access associated with the refunded purchase.

Refund requests must comply with the procedures and conditions contained in the Return & Refund Policy.

10. Books and Physical Products

Musical English may sell books, printed curriculum materials, educational resources, and other physical products.

Unless otherwise stated, a physical item may qualify for a refund only when it is returned to Musical English in unused condition.

Used books or other used physical products are not eligible for a refund.

The purchaser is responsible for returning the product to the designated Musical English return address before a qualifying refund is issued.

Unless Musical English expressly agrees otherwise, the customer is responsible for return shipping and Musical English does not reimburse the cost of return shipping.

Additional return procedures, deadlines, exclusions, and requirements will be stated in the Musical English

Return & Refund Policy.

11. Return & Refund Policy

All purchases are also subject to the Musical English Return & Refund Policy, which is incorporated into these Terms by reference.

If a product-specific sales page contains a refund term that differs from the general Return & Refund Policy, the clearly disclosed product-specific term in effect at the time of purchase will control for that purchase.

Musical English recommends reviewing the Return & Refund Policy before making a purchase.

12. Prices and Payments

Prices may vary according to the product, program, enrollment period, promotion, founding offer, launch offer, membership, school package, or other arrangement.

The price displayed or expressly agreed upon at the time of purchase will govern that transaction.

Unless otherwise indicated, applicable taxes, shipping fees, financing charges, installment fees, or other disclosed charges may be additional.

By submitting a purchase, you authorize the applicable payment processor to charge the payment method you provide for the disclosed amount.

If a payment plan is offered, you remain responsible for all scheduled payments unless the applicable written refund or cancellation terms expressly state otherwise.

Failure to make required payments may result in suspension or termination of access.

13. Payment Plans

Musical English may allow certain purchases to be paid through installments.

If you select an installment plan, you authorize charges according to the schedule disclosed at checkout.

A payment plan is a method of paying the purchase price; it is not automatically a subscription and does not independently create a right to cancel future installments after receiving access, unless the applicable offer, refund policy, or law provides such a right.

If an installment payment fails, Musical English may retry the payment where permitted, contact you regarding the balance, suspend access, or take other reasonable collection steps.

14. Subscriptions and Recurring Services

Certain future Musical English services may be offered through recurring subscriptions, including technology services, LMS memberships, support programs, websites, automation systems, parent memberships, or other ongoing services.

If a product involves recurring billing, the billing frequency, price, renewal terms, and cancellation method will be disclosed before purchase.

A recurring service will continue according to those terms until canceled in accordance with the applicable cancellation procedure.

15. Educational Purpose

Musical English programs are educational in nature.

Musical English does not provide medical, psychological, psychiatric, speech-language pathology, occupational therapy, or other healthcare diagnosis or treatment unless a separate service expressly states otherwise and is provided by appropriately qualified professionals.

Musical English materials should not be used as a substitute for professional medical, developmental, psychological, educational, or therapeutic advice where such advice is needed.

Parents or educators who have concerns about a child's development, health, speech, hearing, learning, or behavior should consult an appropriately qualified professional.

16. No Guaranteed Educational Outcome

Musical English is designed to provide children with opportunities to practice English, listening, vocabulary, pronunciation, communication, social participation, expression, creativity, movement, storytelling, role-play, and confidence through practice.

Educational outcomes vary among children and depend on numerous factors.

Musical English does not guarantee that a child will achieve a particular level of language proficiency, academic performance, developmental outcome, test result, communication ability, or other specific result.

17. No Employment Offer

Teacher training does not constitute an offer or guarantee of employment by Musical English.

Purchasers and participants are responsible for determining how they may appropriately use their training subject to the applicable Musical English agreement and local law.

Musical English does not guarantee that a participant will obtain a job, teaching position, school contract, students, customers, clients, or other employment opportunity.

18. No Earnings or Business Guarantee

Some Musical English teacher-training programs may include information concerning business setup, marketing, teaching opportunities, or operating an independent educational business.

Such information is educational in nature.

Musical English does not guarantee income, profit, revenue, enrollment, customer acquisition, business success, return on investment, or any particular financial result.

Examples, projections, illustrations, case examples, hypothetical calculations, marketing scenarios, or discussions of possible business models are not promises of future performance.

Results depend on factors outside Musical English's control, including a participant's experience, effort, location, market conditions, pricing, expenses, marketing, legal requirements, competition, and business decisions.

Participants are responsible for evaluating their own financial circumstances and obtaining independent legal, accounting, tax, or business advice where appropriate.

19. Independent Business Activities

If a Musical English teacher is authorized under a separate agreement to operate an independent teaching business, that teacher remains responsible for their own business activities unless the applicable written agreement states otherwise.

This may include responsibility for appropriate registrations, permits, insurance, taxes, employment matters, facilities, student safety, advertising, customer relations, pricing, local regulations, and other obligations applicable to their business.

Nothing on the website should be interpreted as legal, tax, accounting, or regulatory advice.

20. Intellectual Property

Musical English programs and materials may contain intellectual property owned by or licensed to Musical English or its rights holders.

This may include trademarks, service marks, trade names, logos, curricula, teaching methods, lesson plans, course content, written materials, books, characters, illustrations, artwork, music, songs, recordings, videos, scripts, stories, worksheets, presentations, designs, photographs, graphics, software, digital files, training materials, and other proprietary content.

Except for rights expressly granted under an applicable written agreement, all intellectual-property rights remain with their respective owners.

Purchasing a Musical English product does not transfer ownership of Musical English intellectual property.

21. Limited Personal Use

Unless a separate Musical English teacher or licensing agreement expressly provides broader rights, materials provided through the website or an educational product are licensed for the purchaser's authorized personal or educational use only.

You may not reproduce, publish, distribute, sell, sublicense, upload, publicly display, publicly perform, modify, translate, create derivative commercial products from, or otherwise exploit Musical English materials except where expressly authorized in writing.

22. Teacher Use of Musical English Materials

Teacher-training enrollment does not automatically grant unlimited commercial use of Musical English intellectual property.

Any right to teach Musical English commercially, reproduce curriculum resources, use copyrighted materials, use Musical English branding, perform Musical English music publicly, distribute books or files, market yourself using Musical English trademarks, or otherwise use Musical English intellectual property in a teaching business must be authorized by the applicable teacher agreement, license, or written program terms.

The applicable written teacher agreement will control if it differs from these general Terms.

23. Copyright Protection

You may not copy, upload, share, redistribute, resell, publish, transmit, reproduce, record, screen-capture for redistribution, or otherwise make Musical English copyrighted materials available to unauthorized persons except as expressly permitted.

This restriction includes unauthorized distribution through websites, social media, cloud-storage links, messaging platforms, file-sharing systems, online marketplaces, video platforms, course-sharing websites, or other distribution channels.

24. Trademarks and Branding

The names Musical English, MyMusicalEnglish.com, associated program names, logos, designs, and other branding may constitute trademarks, service marks, trade names, or other protected branding.

No right to use Musical English branding for commercial purposes is granted except through express written authorization.

Authorized teachers or organizations must follow applicable Musical English branding and marketing guidelines.

25. User-Submitted Content

If you submit reviews, testimonials, comments, questions, photographs, videos, feedback, suggestions, or other material to Musical English, you represent that you have the right to submit that material.

You remain responsible for material you submit.

Musical English may request separate permission before using identifiable photographs, videos, testimonials, or children's content for promotional purposes where appropriate or legally required.

Do not submit confidential, proprietary, copyrighted, or personally sensitive information belonging to another person unless you have the necessary authorization.

26. Children's Images and Student Information

Teachers, parents, schools, and other users must respect children's privacy.

You may not upload or provide Musical English with photographs, videos, names, student records, or other personally identifiable information concerning a child unless you have the legal authority and necessary parental or guardian permission to do so.

Musical English may require additional release forms before using a child's image, recording, testimonial, performance, or other identifiable content.

27. Teacher Communities and Interactive Areas

Musical English may provide teacher communities, discussion areas, course communities, forums, chats, webinars, or other interactive services.

Users must interact respectfully and may not use these services to harass others, distribute unlawful content, infringe intellectual property, transmit malware, collect personal information improperly, advertise unrelated products without permission, or engage in disruptive or abusive behavior.

Information posted in shared or public areas may be visible to other participants. Users should not post confidential or sensitive information in such areas.

28. Acceptable Use

You agree not to use Musical English websites, courses, communications systems, LMS platforms, or other services for unlawful, fraudulent, abusive, deceptive, harmful, or unauthorized purposes.

You may not attempt to gain unauthorized access to systems or accounts; interfere with website or LMS operations; circumvent security controls; scrape or harvest data without authorization; distribute viruses or harmful code; impersonate another person or organization; make fraudulent purchases; misuse payment systems; violate intellectual-property rights; or use Musical English services in a manner that violates applicable law.

29. Suspension or Termination

Musical English may suspend or terminate access to a website, LMS, course, community, account, training program, or other service when reasonably necessary because of nonpayment, fraud, security concerns, material violation of these Terms, intellectual-property misuse, abusive behavior, unauthorized account sharing, unlawful activity, or violation of an applicable agreement.

Where appropriate, Musical English may provide notice and an opportunity to address the issue.

Termination does not eliminate payment or other obligations that arose before termination.

30. IC Phone System

Musical English uses the IC Phone System, together with HighLevel/LeadConnector communications technology, to communicate with customers, prospective teachers, enrolled teachers, parents, educators, schools, and others who provide their telephone number and applicable consent.

Communications may include customer service, inquiries, appointment bookings, confirmations and reminders, enrollment, course access, LMS access, account updates, teacher-training information, Founding Teacher communications, requested information, purchases, transactions, and related support.

Where separately authorized, Musical English may also send marketing communications concerning teacher training, Musical English programs, offers, launches, educational products, parent programs, ESL programs, homeschooling programs, events, and promotions.

31. SMS Terms

By affirmatively opting in to receive SMS communications from Musical English, you consent to receive text messages consistent with the consent provided on the applicable form.

Message frequency varies. Message and data rates may apply.

Reply STOP to opt out of the applicable SMS program. Musical English or the IC Phone System may send a final message confirming your opt-out.

Reply HELP for assistance where supported, or contact Musical English using the information below.

Wireless carriers are not liable for delayed or undelivered messages.

Consent to receive marketing text messages is not required as a condition of purchasing a Musical English product or service.

If you later wish to receive messages after opting out, you may opt in again through an appropriate Musical English form or other authorized process.

32. Non-Marketing SMS Consent

Where a Musical English form contains a separate non-marketing SMS consent, that authorization may cover customer service, inquiries, appointment bookings, enrollment, course access, LMS access, account updates, requested information, purchases, transactions, and related support.

Consent will be governed by the language displayed at the time the individual opts in.

33. Marketing SMS and Email Consent

Where a Musical English form contains a separate marketing consent, that authorization may cover marketing email and text communications regarding teacher training, Musical English programs, Founding Teacher opportunities, special offers, launches, educational products, events, parent programs, homeschooling programs, ESL programs, and promotions.

Marketing consent may be withdrawn using the applicable unsubscribe or STOP mechanism.

34. Privacy

Use of Musical English websites and services is also governed by the Musical English Privacy Policy, which explains how we collect, use, disclose, and protect information.

The Privacy Policy includes additional information concerning HighLevel, LeadConnector, IC Phone System, SMS consent, children, cookies, analytics, service providers, and privacy rights.

The Privacy Policy is incorporated into these Terms by reference.

35. Third-Party Services

Musical English may rely on third-party providers for website hosting, CRM systems, HighLevel, LeadConnector, IC Phone System, payment processing, LMS services, video hosting, analytics, advertising, email, SMS, telecommunications, printing, book production, fulfillment, shipping, accounting, and other services.

Third-party services may have separate terms and privacy policies.

Musical English is not responsible for the independent conduct of a third-party provider except to the extent required by applicable law.

36. Third-Party Links

Our website, courses, or communications may contain links to third-party websites, social-media platforms, payment processors, video services, book providers, or other external services.

A link does not necessarily constitute endorsement.

Musical English does not control independent third-party websites and is not responsible for their content, security, availability, privacy practices, or terms.

37. Availability and Changes to Services

Musical English may modify, update, replace, suspend, or discontinue website features, course features, technology, content, or services from time to time.

We do not guarantee that a particular website, platform, video, technology feature, or service will always be uninterrupted or error-free.

Reasonable efforts may be made to maintain access to purchased services consistent with the applicable offer.

38. Technology and Internet Requirements

Online Musical English services require appropriate internet access, compatible devices, software, and other technology.

Users are responsible for obtaining and maintaining their own internet service, devices, browsers, software, and other equipment required to access online programs unless expressly stated otherwise.

Internet, device, or third-party platform costs are the user's responsibility.

39. No Warranty of Uninterrupted Service

To the extent permitted by law, Musical English does not warrant that websites, LMS systems, videos, communications systems, or other digital services will operate without interruption, delay, error, security incident, or temporary unavailability.

Scheduled maintenance, updates, internet disruptions, third-party outages, and circumstances outside our reasonable control may affect availability.

40. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Musical English websites, educational materials, and services are provided on an “as is” and “as available” basis except for express warranties specifically provided in writing.

Musical English disclaims implied warranties to the extent such disclaimers are permitted by law.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

41. Limitation of Liability

To the fullest extent permitted by applicable law, Musical English and its applicable owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website, courses, products, or services where such limitations are legally permitted.

Any limitation of liability will not apply where prohibited by law.

The final legal version of this section should be reviewed by counsel because enforceability varies by jurisdiction and by the nature of the transaction.

42. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, or expenses resulting from your unlawful use of Musical English services, infringement of another person's rights, misuse of Musical English intellectual property, or material violation of these Terms.

This provision does not require you to indemnify Musical English for conduct for which indemnification cannot legally be required.

43. Force Majeure

Musical English will not be responsible for delay or failure to perform obligations caused by circumstances reasonably outside its control, which may include natural disasters, severe weather, fire, war, terrorism, civil disturbance, labor disputes, governmental actions, epidemics or public-health emergencies, utility failures, internet outages, telecommunications failures, cyber incidents affecting third parties, platform outages, shipping interruptions, or similar events.

This section does not eliminate rights that cannot legally be waived.

44. Governing Law

These Terms will be governed by the laws of [INSERT STATE], without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

The legal entity and governing state should be confirmed before publication.

45. Dispute Resolution

The final dispute-resolution structure should be selected with legal counsel.

Musical English may choose to require informal resolution before litigation and may also consider mediation, arbitration, venue provisions, class-action provisions, or other dispute procedures where lawful and appropriate.

46. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Any invalid provision should be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted.

47. No Waiver

Failure by Musical English to enforce a provision of these Terms on one occasion does not necessarily waive the right to enforce that provision later.

48. Assignment

You may not transfer or assign contractual rights or obligations relating to a Musical English account, teacher program, license, or course except where Musical English expressly permits such transfer.

Musical English may assign its rights and obligations in connection with a merger, acquisition, restructuring, financing, sale, transfer of assets, or similar business transaction, subject to applicable law.

49. Entire Agreement

These Terms, together with the Musical English Privacy Policy, Return & Refund Policy, applicable purchase terms, teacher agreements, licenses, program-specific terms, and other documents expressly incorporated by reference, constitute the agreement governing the applicable Musical English product or service.

If a separately signed agreement conflicts with these general Terms, the separately signed agreement generally controls with respect to the subject matter it specifically addresses.

50. Changes to These Terms

Musical English may update these Terms periodically to reflect changes in our programs, services, technology, business operations, or legal requirements.

The Last Updated date will identify the most recent version.

Where legally required or reasonably appropriate, Musical English may provide additional notice of material changes.

Changes will apply prospectively except where law permits otherwise.
